Development plan no. 652B "Kaiserlei Nordost; eastern part" - Announcement and entry into force
1. entry into force
On 22.05.2025, the municipal council of the City of Offenbach am Main adopted development plan no. 652B "Kaiserlei Nordost; östlicher Teil" as a statute in accordance with Section 10 (1) of the German Building Code (BauGB).
The development plan no. 652B with explanatory statement and summary declaration pursuant to Section 10 (3) sentence 2 BauGB can be inspected during office hours at the Municipal Office of the City of Offenbach am Main - Surveying Office -, Berliner Straße 60, 11th floor, room 1107. In addition, the development plan that has come into force, together with the explanatory memorandum, will be posted on the Internet at www.offenbach.de/bebauungsplan.
The development plan comes into force with this announcement.
2. notice pursuant to Section 44 (5) of the German Building Code (BauGB)
Reference is made to the provisions of Section 44 (3) sentences 1 and 2 BauGB on the assertion of compensation payments by written application to the party liable for compensation in the event of the pecuniary disadvantages described in Sections 39 to 42 and Section 44 (4) BauGB on the expiry of compensation claims if the claim does not fall due within 3 years of the end of the calendar year in which the pecuniary disadvantages occurred.
3. notice pursuant to Section 215 (2) of the German Building Code (BauGB)
It is pointed out that
1. a violation of the procedural and formal regulations specified in Section 214 (1) sentence 1 nos. 1 to 3 BauGB,
2. a violation of the provisions on the relationship between the development plan and the land use plan, which is notable under Section 214 (2) BauGB, and
3. in accordance with Section 214 (3) sentence 2 BauGB, notable deficiencies in the balancing process
shall only be taken into account if they have been asserted in writing to the City of Offenbach within one year of this announcement. The facts justifying the violation must be stated. This applies accordingly if errors pursuant to Section 214 (2a) BauGB are relevant.
