PURPOSE OF DATA PROCESSING: For the initiation and execution of contracts and the provision of care at an EKO daycare center (Art. 6(1)(b)), as well as to comply with legal obligations (Art. 6(1)(c) GDPR), personal data of the child in our care, the persons authorized to care for and pick up the child, and the account holders is processed. Insofar as special categories of personal data are involved (for example, the child’s health data), processing is carried out on the basis of relevant legal provisions in conjunction with Art. 9(2)(b), (h), and (i) of the GDPR. If the required information is not provided, a childcare contract cannot be concluded with you, and childcare services cannot be provided. Where applicable, the processing of personal data is based on your consent (Art. 6(1)(a) GDPR).

For the purposes of needs assessment, ensuring availability, and billing for appropriate child care services (Section 24 of Book VIII of the Social Code (SGB VIII), § 79 SGB VIII in conjunction with § 30 HKJGB), we process personal data of the child to be cared for, the legal guardians, and any siblings belonging to the household (Art. 6(1)(c), Art. 9(2)(b), (h) of the GDPR in conjunction with § 3(1) of the HDSIG).

RECIPIENTS: We will only disclose your personal data if permitted by law. Depending on the circumstances, data may be disclosed to the following recipients: Offenbach Youth Welfare Office (Office 51), Offenbach Audit Office (Office 14), Offenbach Treasury and Tax Office (Office 20), Offenbach Public Health Department (Office 53), MainArbeit (Office 58), the State and Federal Audit Offices, the City of Offenbach Social Services Office (Office 50), and data processors. The data is transferred for the purposes of needs assessment and coordination of space allocation, to secure subsidies for operating costs, to fulfill childcare contracts and legal requirements, to operate the daycare app, and for the software-related implementation, maintenance, and support of the necessary databases and processing operations. No data is transferred to third countries.

STORAGE: Personal data will be deleted as soon as the purpose for which it was collected no longer applies and there is no legal obligation to retain the data that would prevent its deletion. Registrations for which a legal entitlement to a specific type of childcare no longer exists (for example, the registration of a three-year-old child for daycare) will be deleted. The deletion of childcare contract data is governed by the statutory retention rules for contract and billing documents.

YOUR RIGHTS: You have the right to access personal data concerning you or your child. You may also request the correction of inaccurate data. In addition, under certain conditions, you have the right to erasure, the right to restrict data processing, and the right to data portability. If data processing is based on consent, you have the right to withdraw your consent at any time. This does not affect the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.

If the legal requirements under Article 21(1) and (2) of the GDPR are met, you have the right to object to the processing of your data. You also have the right to file a complaint with a data protection supervisory authority. We do not use profiling or automated decision-making.
