General Terms and Conditions of vhs Offenbach
1. general
These GTC (General Terms and Conditions) apply to all events of the Adult Education Center (vhs), including those that are carried out by means of electronic data transmission.
2. registration
Registration is always required for courses at the Volkshochschule Offenbach. Registration is only possible and binding in conjunction with a SEPA mandate for direct debit or by invoice (see point 3). Separate registration procedures apply for study trips and excursions. Please refer to the special information sheets.
By registering for one of our events, you accept the General Terms and Conditions of vhs Offenbach.
Your signature on the registration list for the following course in the next semester is also considered a binding registration. The obligation to pay the fees arises with a binding registration. Absence from the course does not release you from the obligation to pay.
You will receive confirmation of your registration by e-mail, but no confirmation of registration will be sent by post.
Should an event be canceled, we will inform you in good time.
3. fees and payment
The vhs charges fees. The obligation to pay the fees arises upon registration in accordance with the advertised amount.
If you participate in the SEPA direct debit scheme, the fees will be debited.
We will debit your account within 14 days of the second course date for courses with 10 or more dates, and within 14 days of the start of the course for all other courses.
If an account does not have the required cover, the bank holding the account is under no obligation to honor the debit. Bank charges for non-payment will be borne by the participant.
We charge 5 EURO for issuing an invoice.
4. reduction and exemption from charges
If a reduced fee is advertised, this will be granted upon presentation of a current official proof with the registration, but at the latest at the beginning of the course. A reduced fee is granted for recipients of benefits in accordance with SGB (Social Code) II, SGB III Section 16 or SGB XII, for trainees, pupils, students, participants in voluntary services, severely disabled persons with a degree of disability of 50 or more (Section 2 SGB IX) and pensioners.
This discount is generally granted to all persons over 65.
The discount does not apply to special costs, study trips and travel, educational vacations, special events and special or intensive courses.
If you present your volunteer card (E-Card), you can attend lectures free of charge and pay the reduced fees.
Exemption from fees can be granted for recipients of benefits according to SGB II or SGB XII, provided that the relevant social benefit provider approves the payment of the fees. Forms are available from the vhs service office.
5. resignation
5.1 For courses with fewer than 10 event dates, withdrawal is possible up to 10 calendar days before the start of the course. This also applies to online courses. Absence from the course does not release the participant from the obligation to pay.
5.2 In the case of courses with at least 10 course dates, there is usually an opportunity during the first course date to get to know the working methods, performance level and content of the course. You can re-register after the first course date or - if no parallel course is offered - cancel your registration. However, this is only possible if the vhs receives a written informal deregistration or re-registration before the second course date, otherwise the fees will be due (see point 2).
5.3 In the case of educational leave, withdrawal is possible up to 4 weeks before the start of the course.
5.4 For study trips and study tours, special withdrawal conditions apply.

6. termination by the vhs
The vhs can terminate the event contract under the conditions of Section 314 BGB (German Civil Code). A reason for termination exists in particular in the following cases:
- Behavior that is contrary to the community in events despite prior warning and threat of termination by the lecturers, in particular disturbance of the information or event operation through noise and noise nuisance or querulous behavior,
- Defamation of any kind towards lecturers, contractual partners or employees of the vhs,
- Discrimination against persons due to personal characteristics (age, gender, skin color, ethnic or religious affiliation and others)
- Misuse of events for party-political or ideological purposes or for agitation of any kind,
- Significant violations of the house rules. Instead of termination, the vhs may also exclude participants from an event unit. The vhs's entitlement to remuneration shall not be affected by such termination or exclusion.
7. force majeure
Notwithstanding the possibility of termination for good cause, in the event that the vhs is prevented from fulfilling the contract due to force majeure such as war, endemic, pandemic, severe flooding, fire, typhoon, storm and earthquake, the period for the fulfillment of the contract shall be extended by the period during which the force majeure exists.
"Force majeure" means the occurrence of an event that prevents vhs, at least temporarily, from fulfilling one or more of its contractual obligations under the contract, if and to the extent that vhs can prove that the obstacle is beyond its reasonable control,
- that this impediment is beyond its reasonable control,
- that the event was not reasonably foreseeable at the time the contract was concluded
- foreseeable at the time the contract was concluded,
- and that the effects of the impediment could not reasonably have been avoided or overcome by vhs.

The vhs shall inform participants at least on the website about the occurrence of "force majeure" and about the suspension of the obligation to perform. If the conditions for the assumption of "force majeure" no longer apply, the vhs shall inform the participants at least on the website, otherwise by e-mail, text message or telephone. If the effect of force majeure lasts longer than 60 (sixty) days, the participants have the right to terminate the event contract without notice with the consequence of a rescission of the contract in accordance with the statutory provisions.
8 Organizational changes
There is no entitlement to a course being held by a specific lecturer. This also applies if the event has been announced with the name of a lecturer. The adult education center can change the time and place of the event for objective reasons.
If an event has to be canceled (e.g. due to illness of a lecturer), it can be rescheduled. However, there is no entitlement to an alternative date.
9. certificates of attendance
Certificates of attendance are issued on request after completion of the courses. Certificates of attendance are issued without request for courses in the program area of work, PC and multimedia.
10. liability
The Adult Education Center accepts no liability whatsoever towards participants and visitors to all events, including for losses, accidents or damage. Participants and visitors who damage furnishings or equipment in the course of the events through intentional, negligent or grossly negligent behavior are personally liable for this.
11. classrooms
11.1 We hold events at various locations. The house rules applicable at each location apply. Smoking (including e-cigarettes) is strictly prohibited in all classrooms, corridors and schoolyards. The classrooms must be left clean and tidy.
11.2 Use of the lockers in the vhs:
Lockable lockers are provided in the adult education center for sports courses. The lockers may only be used while the participant is present at the vhs. The vhs is entitled to open and clear out occupied lockers if they are also used outside attendance times.
12. wishes, suggestions, criticism
In order to put together an interesting and varied vhs program, we rely on your feedback. We are happy to receive your wishes, suggestions and criticism. Please contact the relevant departments and our service office.
13. accessibility
In principle, all vhs events are open to people with disabilities. As our venues are very different, we ask disabled participants to contact us in advance either in person or by telephone (telephone: 069 8065-3154) so that we can provide information about the spatial conditions or - if possible - take appropriate measures.
The vhs building at Berliner Straße 77 has a disabled WC and a disabled parking space at the Französisches Gässchen/Glockengasse entrance.
Data protection
Right of withdrawal
(1) Cancellation policy (purchase of goods)
Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods. In order to exercise your right of withdrawal, you must inform us (Volkshochschule Offenbach, Berliner Straße 77, 63065 Offenbach am Main, telephone number 069 8065-3141, e-mail: vhsoffenbachde of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). To comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. Consequences of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest. You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
(2) Cancellation policy (service)
Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. Consequences of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. If you have requested that the service should commence during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided by the time you inform us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract. The right of withdrawal does not apply to a contract for the provision of services in the areas of accommodation for purposes other than residential purposes, transportation of goods, vehicle rental, delivery of food and beverages and the provision of other services in connection with leisure activities, if the contract provides for a specific date or period for the provision (Section 312g (2) No. 9 BGB). In this case, the withdrawal regulations of the General Terms and Conditions of VHS Offenbach am Main apply.
