Nature conservation advisory board

The Nature Conservation Advisory Board advises the nature conservation authority on fundamental nature conservation issues. The task arises from Section 22 of the Hessian Implementation Act to the Federal Nature Conservation Act (HAGBNatSchG).

Overview

This participation was specified as follows in the rules of procedure of the advisory board in Offenbach:

The tasks of the Nature Conservation Advisory Board are derived from the provisions of the Federal Nature Conservation Act. These are, in particular, participation in

  • the preparation of legal ordinances and statutes,
  • planning and planning approvals in accordance with other legal provisions of supra-local importance in which the nature conservation authority is involved,
  • Procedures in which the lower nature conservation authority has the power to make decisions or participate, and which concern protected objects in accordance with §§ 20-30 BNatSchG or interventions in accordance with §§ 14 ff BNatSchG.
  • Measures and projects that concern species protection regulations in accordance with §§ 37-47 BNatSchG.

The members of the nature conservation advisory board, whose term of office is five years, are appointed by the municipal council. They must not only be familiar with the area, but also knowledgeable. According to the Hessian "Ordinance on Nature Conservation Advisory Councils", "expertise" requires "special knowledge and skills in the field of nature conservation, landscape conservation, biology, vegetation science or similar branches of knowledge".

Recognition as a nature conservation association is granted on the basis of Section 3 of the Environmental Appeals Act. Among other things, the associations must "focus on promoting the objectives of nature conservation and landscape management".

  • German Federation for the Environment and Nature Conservation
  • German Mountain and Hiking Associations
  • Association of Hessian Fishermen
  • Botanical Association for Nature Conservation Hesse (BVNH) e.V.

The Offenbach Nature Conservation Advisory Board has 12 full members, nominated by the recognized environmental and nature conservation associations and from among the city councillors. It usually meets once a quarter. Special meetings can be convened in cases where a decision needs to be made at short notice. The meetings are not open to the public. The term of office ends on August 31, 2023, after which a new advisory board will be appointed.

The Chairman of the Nature Conservation Advisory Board is Hans-Peter Seidel, his deputy is Ulrich Stenger.

In addition, the Advisory Board has appointed Dr. Sybille Schumann as Nature Conservation Officer.

By resolution of the Advisory Board, the Lower Nature Conservation Authority in the Office for the Environment, Energy and Climate Protection has been tasked with managing the Advisory Board.
