Emissions/immissions/immission control

As a neighbor of a facility, which can be a business or just a piece of land, you must tolerate immissions to a certain extent if you are not or only insignificantly affected by them.
How much impairment you have to tolerate generally depends on whether or not there is a significant nuisance, harmful environmental impact or other hazards (e.g. factory noise in the vicinity of industrial sites or pollutant emissions from industrial plants).
An insignificant impairment exists if the official immission values of TA-Lärm or TA-Luft are not exceeded and the emission values for the prevention of harmful environmental effects are complied with at the facilities. In this context, higher requirements are imposed on installations requiring a permit than on installations not requiring a permit.
