If the habitability of a living space is significantly impaired due to a failure to perform maintenance, the municipality may order the owner to carry out the necessary maintenance.

In cases of unfit living conditions, the local government may require that the structural condition of apartments or living spaces be modified accordingly. This applies in particular to situations where there is no electric lighting, no cooking facilities, an inadequate water supply, or inadequate sanitary facilities. Furthermore, living conditions are considered unacceptable if there is obviously insufficient heat insulation or soundproofing, if the ceiling height is too low (less than 2 m), or if the floor area is too small (no living area in the dwelling with at least 9 square meters). Sufficient natural light and adequate ventilation must be ensured, as must the protection of walls, ceilings, or floors from persistent moisture penetration or infestation by mold or animal pests.

If the defects are so severe that there is a risk of harm to the residents’ health and the defects cannot be remedied, the apartments or living spaces must be declared uninhabitable.
